Terms of use
These Terms are an agreement between you and Lumen Nursing Education Group LLC, a California limited liability company ("Lumen Nursing," "we"). They cover a Lumen Nursing account: what you are buying, how long it lasts, what you may and may not do with it, and what happens if something goes wrong. By creating an account or sitting the free readiness exam you agree to them. Plain words on purpose; where a word has a legal meaning, it is meant that way.
Who can hold an account
You must be at least 18 years old and able to enter a contract. Accounts are for nursing students, nursing graduates preparing for licensure, and the schools that teach them. If you create an account for a school, you confirm you are authorized to bind it.
One account is one person. You are responsible for what happens under your login, for keeping your password and passkeys to yourself, and for telling us at once if you think someone else has used the account.
What an account gives you
We sell two products. NCLEX preparation is a question bank written to the licensure test plan. Lumen Nursing School is a separate bank written to nursing program course objectives. One account can hold either or both; each product has its own plan, its own end date and, where it renews, its own subscription. A nursing school plan does not include NCLEX access, and an NCLEX plan does not include the course bank.
A paid plan opens the full question bank of that product for the length of the plan, in the browser on your phone, tablet and computer, on one account. Access is personal and non-transferable: sharing a login, or using one account for a class, is a breach of these terms and we may close the account without refund.
NCLEX plan lengths run from the day the plan starts, not from first use. A 90-day plan bought on the first of the month ends 90 days later whether or not you studied.
A free account gives you thirty practice questions and the free readiness exam. We may change what a free account includes at any time.
Subscriptions and automatic renewal
Two products are sold as subscriptions. The NCLEX 30-day plan renews automatically every month. Lumen Nursing School is sold in three terms: one month (renews every month), six months (renews every six months) and twelve months (renews every year). Every subscription renews at the end of each period until you cancel. You are told so next to the button on the page where you pay, it is restated in your confirmation email, and we email you again three days before each renewal charge.
A renewal is charged at the price you paid, not at the list price. If we change the price of a term, the change applies to new purchases; your own renewals stay at the rate you started on unless you are given at least 30 days notice by email and choose to continue. There is no charge you have not been told about in advance.
Cancel at any time from Plans inside the app, in one step and without contacting us. Canceling stops the next charge and nothing else: every course, every question and all of your recorded work stay open until the end of the term you have already paid for. You can resume renewals from the same page.
If a renewal payment fails we tell you by email and try the card once more about a day later; your access stays open meanwhile. If the second try fails, or nothing has been paid 48 hours after the first failure, the subscription stops and the account returns to the free tier. Work already recorded is kept, and paying again reopens the bank where you left it.
Payment is processed by Stripe under its own terms. We do not receive or store your card number. Prices are in US dollars; any sales tax due is shown before you pay.
The NCLEX 60-, 90- and 180-day plans are not subscriptions. Each is a one-time payment for a fixed run of access. They do not renew and there is nothing to cancel.
The free readiness exam
The free readiness exam is one sitting per person, tied to a verified email address and the device it is taken on. It is one fixed form: every candidate on a track sits the same questions, which is what makes it a readiness check rather than a way to read the bank for free. Second attempts are declined. If you share a device with another candidate, write to us before they sit it.
The result is a readiness band with a section breakdown. It is an estimate drawn from your own answers against the published test plan. It is not a prediction we stand behind in the way a licensing board stands behind a result, and it must not be relied on as one.
Secure mode and monitoring
The readiness exam, the Adaptive CAT, Test sets and the Predictor run in secure mode. Where your browser allows it, the sitting takes the whole screen. Leaving the sitting (another tab or application, switching away on a phone, exiting full screen, connecting a second display) is recorded against the sitting with the time and the question you were on, and you are asked to acknowledge the record before the question returns. The record is kept with the result and may be shown to a school that paid for your seat.
Secure mode is a web page, not an installed proctoring client. It does not access your camera, microphone, files or other applications, and it cannot prevent you from leaving; it records that you did. Copying, printing and screen capture of exam content are blocked where the browser allows and recorded where it does not.
School seats
A school buys seats and invites students to claim them. A claimed seat belongs to the student, and the school sees aggregate progress: questions answered, section scores, readiness, how often the student practices, and secure-mode records. A school never sees an individual answer, a notebook, or another school.
When a school’s access period ends, student accounts revert to the free tier. Work already recorded (answers, notebook entries, flashcards) stays on the student’s account. School invoices and seat counts are governed by the school’s order and, where one exists, its signed agreement, which takes precedence over this section.
Refunds
Refund eligibility. Refunds are governed by the Refund Policy, which is part of these Terms. In short: a first purchase can be refunded within 7 days if fewer than 50 questions have been answered. Renewals are not refundable, except within 5 days of the renewal charge when zero questions have been answered since it. The always-refunded cases and the cancellation rights in the Refund Policy apply in every case.
Usage limits and fair use
Usage limits and fair use. Each account may submit up to 120 questions per hour and 400 questions per rolling 24 hours. These limits are well above normal study use. They protect the question bank from scraping and from shared accounts. These limits apply to practice questions (tests and practice sets). They do not apply to Predictor sittings, which are unlimited. Unlimited Predictor use is still subject to fair use and to the anti-scraping, no-automation and no-sharing rules below.
When you reach a limit. You will see a message telling you when you can continue. Your account, progress and paid time are not affected, and you are not charged anything extra. Reaching a limit is not, by itself, a breach. Repeatedly reaching limits together with other signs of automated access or account sharing (many devices or locations at once, scripted request patterns) may lead us to review the account under the anti-scraping section. Where the issue can be fixed, we will warn you before suspending the account.
The limits support the no-copying, no-scraping and no-sharing section. They do not narrow it: automated copying is prohibited at any volume, including in the Predictor.
Acceptable use
You may use the bank to prepare yourself, or, as a school, to prepare the students whose seats you bought. You may not: share or resell access; copy, photograph, record, scrape, download or otherwise reproduce questions, rationales, images or audio, by hand or by any automated means; publish or distribute any of them; use them to build, train or improve another product, service or model; probe, overload or interfere with the service; or attempt to defeat secure mode, the one-sitting rule, or any other limit.
A breach ends the account without refund, and we may recover from you the costs the breach caused us. Where a breach is also unlawful we may refer it to the authorities.
Content, accuracy and what we promise
Every item is written by a nurse educator and reviewed by a second one. We still get things wrong. Report an item from inside the question: it leaves your rotation immediately, a nurse editor reviews it, and you are told what changed. Corrections are versioned rather than silent.
Nothing on Lumen Nursing is clinical advice, and nothing here replaces your program, your textbooks or your clinical judgment. The bank is a study tool. Doses, procedures and values in questions are written for examination practice and must not be used to care for a patient.
No practice bank can promise an examination result, and we do not. Readiness bands, section scores and the Predictor are estimates from your own answers; they are not a guarantee that you will pass or fail the NCLEX or any course, and we accept no responsibility for the outcome of an examination you sit.
The service is provided as it is and as available. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the service will be uninterrupted or error-free, though we work hard to make it so and we tell you when it is not.
Our content is ours
Questions, rationales, images, audio, the interface, the software and the Lumen Nursing name and mark belong to Lumen Nursing or its licensors and are protected by copyright and trademark law. Your plan gives you a limited, personal, revocable, non-transferable license to use them for your own preparation while the account is open, and nothing more.
Anything you type into the service (notes, reports, support messages) stays yours. You give us a license to store it, show it back to you, and use reports and support messages to fix the bank. Aggregate, de-identified statistics about how questions perform are ours.
NCLEX® is a registered trademark of the National Council of State Boards of Nursing, Inc. (NCSBN). Lumen Nursing is not affiliated with, endorsed by or sponsored by NCSBN, and our content is not the licensing examination.
Limitation of liability
To the fullest extent the law allows, Lumen Nursing, its owners, staff and contractors are not liable to you for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities, exam fees, tuition, or the cost of a substitute service, arising out of or connected with the service or these terms, however caused and on any theory of liability, even if we were told such damages were possible.
Our total liability to you for everything arising out of the service or these terms is limited to the greater of the amount you paid Lumen Nursing Education Group LLC in the twelve months before the claim and fifty US dollars.
Some states and countries do not allow some of these limits. Where that is so, the limits apply to the fullest extent permitted, and nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Your responsibility to us
If a third party brings a claim against us because you broke these terms, broke the law, or infringed someone’s rights using the service, you agree to cover the costs and damages that result, including reasonable legal fees. We will tell you about the claim promptly and let you take part in the defense.
Closing an account
You can close your account at any time by emailing us from the address on it. We can suspend or close an account that breaks these terms, that we reasonably believe is being used fraudulently, or where the law requires it; where the breach is minor and curable we will warn you first. Closing an account for a breach does not entitle you to a refund. Sections on content, liability, your responsibility to us and disputes survive closing.
Disputes and governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
If something goes wrong, tell us first: email us with what happened and what you want, and we will try to put it right within 30 days. Most problems end there. If one does not, either of us may bring a claim in small-claims court where you live or where we are organized, or in the state or federal courts of the state whose law governs these terms, and both of us agree to those courts’ jurisdiction. Each side may bring claims only on its own behalf, not as a plaintiff or class member in a class or representative action, to the extent the law permits that limit.
Nothing in this section takes away rights that the consumer-protection law of your home state or country gives you and that cannot be waived.
Changes and contact
If we change these terms materially, we will say so by email to the address on your account at least 14 days before the change takes effect, and the change will not apply to a plan already paid for until it renews or is renewed. Continuing to use the service after the date means you accept the new terms; if you do not, close your account before then and the refund section applies as if you had asked on the day we wrote.
If a part of these terms is found unenforceable, the rest stands. These terms, the Privacy policy and, for a school, its signed agreement are the whole agreement between us about the service.
